These terms of service apply to all users of the domain littlebluenest.com (“the website”) and their sub-domains which is operated by LBN Baby Ltd trading as Little Blue Nest registered in England and Wales. The terms and conditions will be valid for all your future transactions with Little Blue Nest (henceforth referred to as “Little Blue Nest” “we” or “us”. By using this website you agree to accept these conditions. If you do not agree with these conditions, you should not use the website. We reserve the right to revise these conditions at any time. We advise that you check back periodically to keep updated with any changes. The date for the latest update can be found in the final section of this document.

If you have been charged the wrong amount for an order, we will give you the option of placing a new order with the correct price or canceling your order. However, Little Blue Nest reserves the right to cancel any order prior to dispatch should we find that we have identify an error within the Product information, including price or promotion or we are unable to obtain authorisation of payment. In such case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled. Little Blue Nest cannot be held responsible for any damaged caused from using the site or, not being able to use the site. Little Blue Nest cannot guarantee problem-free, uninterrupted, and secure access to the site.

One discount code or free delivery (UK only) offer (“the offer”) may be used per order / transaction unless otherwise stated. The offer cannot be used in conjunction with any other discount, offer or voucher code. Little Blue Nest reserve the right to remove or amend conditions of the offer at any time; this does not affect your statutory rights.

COLOURS

Every effort has been made to display the colours of our products as accurately as possible. However, colours you see will vary depending on your monitor / or browser you use to view the website. We cannot accept responsibility for any variation in colour caused by the browser software or computer system. Please note that due to the increased use of photography presets and filters used on social media websites submitted by users, the colours in these photographs may not be an accurate reflection of the products - as such we cannot accept responsibility for colour inaccuracy from user submitted photographs. Descriptions, photographs, specifications or illustrations on the website are published for the sole purpose of giving an approximate idea of the products described on the website and will not form part of the contract with you. No warranty or guarantee is expressed or therefore implied in this regard.

SHIPPING ERRORS, NOTICE OF DEFECTS

You should inspect the Goods on receipt and notify Little Blue Nest in writing within 5 days of receipt of the delivery of any claims for damages resulting from any defects including, without limitation, claims related to shortages, quality, or specification. Little Blue Nest will accept the return of the items with claims relating to quality and either repay the unit price in full or offer credit or replacement after assessing the item. The Goods you return must not have been worn, used or washed and should be returned in the original packaging. We will be under no liability or further obligation in relation to the Goods if you fail to provide notice as set above; and/or you make any further use of such Goods after giving notice under the clause above relating to damages and shortages; and/or the defect arises because you did not follow our oral or written instructions about the storage, commissioning, installation, use and maintenance of the Goods; and/or the defect arises from normal wear and tear of the Goods.

USER SUBMISSIONS

Any photographs or other content submitted by you for consideration for publication on the Little Blue Nest Site, (henceforth referred to as “Submissions,”) shall be subject to the provisions of these Terms and Conditions. You understand that your Submission will be for use on the companies website and consent to use for other marketing and publicity-related purposes including (but not limited to), printed and online publicity, social media, press releases. Whether or not any of your Submissions are published, Little Blue Nest does not guarantee any their confidentiality, we can not promise or agree to publish your Submissions. We will not return any Submissions. . You are solely responsible for your Submissions and the consequences of the posting or publishing of them. You affirm and warrant that you own and have the right to assign and transfer to Little Blue Nest without permission or consent of any third party. By tendering the User Submissions to us you warrant and agree that all intellectual property rights contained including all copyright, trademark, trade secret, and any other proprietary rights are thereby assigned and transferred to Little Blue Nest without any further documentation and that we shall thereafter be the sole and exclusive owner of the Submissions and of all intellectual property rights and proprietary rights contained there without exception or limitation. Further, as to any User Submissions invited by Little Blue Nest to be submitted for consideration of publishing on its Site, you warrant and agree that no law was violated and no right of any person was harmed in obtaining creating or developing the material included within the User Submissions. You warrant, represent and agree that Little Blue Nest has the sole right to elect to publish or not to publish the User Submissions, and if published it has the right to terminate publication in its sole discretion without liability to you or to any third party. 

You agree that your User Submissions: Shall not misrepresent any person or product; shall not falsely impersonate any person or product; shall not contain any false, misleading or deceptive trademarks, devices or symbols that could tend to confuse or could likely confuse any person as to the source, sponsorship, affiliation, membership, quality, characteristics, or features of the person or product represented in the User Submissions; Shall not depict a minor person under the age of 18 years without consent of the parent or guardian of the minor person; Shall not be copied by you or anyone else under your instruction or control; Shall not have been published previously on any website or other medium prior to submission to Little Blue Nest; shall not be liable to you or to any third party for any royalty, payment, use fee or any other consideration for or pertaining to the publishing, copying, distribution or any other use of the User Submissions without limitation.

RULE VIOLATIONS

Little Blue Nest reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.
